You are responsible for safeguarding your account password and for all activities or actions under your account.

3. Messaging and Third-Party Communications

3.1 User-Initiated Messaging

The Services may allow you to send messages to your contacts via third-party services, such as the Twilio API. By using this feature, you confirm that:

• You have obtained prior consent from your contacts to receive such messages.

3.2 Skiva’s Role in Messaging

Messages sent through the Services will be sent by Skiva on behalf of the user initiating the message. Skiva is not responsible for the content of messages sent by users.

3.3 Opt-Out Requirements

Messages sent via the Services must include a mechanism for recipients to opt out of receiving further communications. Skiva reserves the right to disable messaging features for users who fail to comply with these requirements.

4. User Content

You retain ownership of any content you submit, post, or display on or through the Services (“User Content“). By submitting User Content, you grant Skiva a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, modify, distribute, and display such User Content in connection with the Services.

5. Prohibited Conduct

You agree not to:

• Use the Services for any illegal or unauthorized purpose;

• Post, upload, or distribute any defamatory, obscene, or otherwise harmful content;

• Engage in any activity that interferes with or disrupts the Services;

We may terminate or suspend your access to the Services at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Services will immediately cease.

7. Disclaimers

The Services are provided “as is“ and “as available“ without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

8. Limitation of Liability

In no event shall Skiva, its directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
(i) your use or inability to use the Services;
(ii) any unauthorized access to or use of our servers and/or any personal information stored therein;
(iii) misuse of the messaging feature by users.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Skiva operates, without regard to its conflict of law principles.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
